Senator Chris Van Hollen (D-MD) stated during an appearance on ABC’s This Week that his recent trip to El Salvador was not intended to defend Kilmar Abrego Garcia personally, but rather to advocate for the protection of due process rights. His comments come amid ongoing debate surrounding the deportation of Abrego Garcia, a case that has drawn national attention and criticism from various political figures, including former President Donald Trump.
Van Hollen responded to questions from host Jonathan Karl regarding the nature of his support for Abrego Garcia, who was deported last month under orders from the Trump administration. The senator emphasized that his efforts were focused on ensuring that legal procedures were followed and that constitutional rights were upheld, regardless of Abrego Garcia’s immigration status or allegations associated with him.
Karl referenced accusations against Abrego Garcia, including a 2021 protection order obtained by his wife and additional allegations of abuse. He asked Van Hollen whether he was concerned about publicly supporting an individual with what he described as a “questionable record.”
Van Hollen clarified his stance, stating, “I am not defending the man. I’m defending the rights of this man to due process.” He added that the Trump administration had, in court proceedings, acknowledged that Abrego Garcia was both wrongfully detained and wrongfully deported.
The senator also addressed criticism that he and other Democrats were focusing on political attacks rather than legal accountability. He pointed to federal court records and referenced comments by U.S. District Judge Paula Xinis, who presided over the case involving Abrego Garcia. According to Van Hollen, the court concluded there was no evidence linking Abrego Garcia to the MS-13 gang or to any terrorist activity. He cited the judge’s statements directly, underscoring that the administration had failed to present any such evidence during proceedings.
In further defending the rationale behind his trip to El Salvador, Van Hollen reiterated the importance of maintaining the integrity of the legal system. “If we take it away from him, we do jeopardize it for everybody else,” he said. He also challenged those criticizing the judicial process to present their claims through formal legal channels, saying, “Put up or shut up in court.”

Karl noted that constitutional rights extend even to individuals who are undocumented or face serious allegations, a point Van Hollen agreed with. The senator stressed that, irrespective of Abrego Garcia’s background, the appropriate venue to evaluate those claims is through the judiciary and not social media or political commentary.
Van Hollen also mentioned that Abrego Garcia’s wife — the same individual who had previously obtained a protective order — is now reportedly supporting his return and seeking the restoration of his legal rights. This development has added complexity to the public discourse surrounding the case.
The case of Kilmar Abrego Garcia has become a focal point in broader debates over immigration enforcement, executive power, and judicial oversight. It has also highlighted ongoing tensions between federal enforcement actions and legislative oversight, particularly as it pertains to deportation proceedings and constitutional protections.
At present, there are no indications from the Department of Homeland Security or the Department of Justice regarding plans to revisit or reverse the deportation. Meanwhile, advocacy from lawmakers, including Van Hollen, continues to draw attention to the legal implications of the case and the processes by which such decisions are made.
